The city sprawls into a small part of DeKalb County, including stretches of Moreland Avenue at Memorial Drive and North Druid Hills Road north of I-20. The Municipal Court of Atlanta is the largest municipal court in Georgia, and it sits at 150 Garnett Street downtown. Here is what happens if you miss a court date in the Atlanta Municipal Court. The judge typically calls your case, notes that you are absent, and enters a failure to appear (FTA). In most misdemeanor and traffic matters, the court then issues a bench warrant, and any cash bond you posted becomes subject to forfeiture.

The bench warrant is the first consequence, and it is the one people underestimate. A bench warrant does not expire on its own. It stays active in the system until a judge lifts it. Until that happens, any later contact with police can end in an arrest, including a routine traffic stop or a license check that has nothing to do with the original charge.

Bond forfeiture runs on a separate track. Under Georgia law, a court may declare a bond forfeited when the defendant fails to appear as required. A companion statute sets out the forfeiture hearing procedure and the window in which the court must act before entering judgment. That window is measured in months, so moving quickly gives you a better chance to ask the judge to set the forfeiture aside.

A driver's license suspension is the third consequence. For traffic citations, the court reports the missed appearance to the Georgia Department of Driver Services. Once out of jail, and after receiving your personal belongings, you MAY no longer have your driver’s license. How to Clear a Failure to Appear in Atlanta Municipal Court

The Municipal Court of Atlanta publishes its own procedure, and it is not a same-day walk-in. To address an FTA you must request a new court date on the court's request for reset form, which the clerk provides in person at 150 Garnett Street. The court then mails a notice to appear with the date and time for FTA Court, sent to the address on your citation. If you have moved, change your address with the court first, or that notice goes to the wrong place.

Bring three things. First, your citation number or case number, which the court clerk needs to pull the file. Second, a government issued photo ID. Third, written proof of why you missed the original date, if you have it. Hospital discharge paperwork, a work schedule, a jury summons from another court, or a towing invoice all carry more weight than a verbal explanation. If you have no documentation, go anyway. Timing changes your posture. Coming forward on your own is generally viewed more favorably than being arrested on the warrant weeks or months later, after the suspension and the forfeiture have already moved forward. Every step still rests in the judge's discretion, so no attorney can promise a particular result.

Verify current clerk hours before you go. The City of Atlanta sets them and they change around holidays and city closures. If your case is already in warrant status, consider asking counsel to handle the reset with you. A lawyer can explain the absence and ask for the warrant to be recalled.

  3. Call the clerk's office and ask staff to confirm whether the case is in FTA status and whether a bench warrant has issued.

Do not rely on the mail. Courts reset dates for many reasons, and a defendant who never receives the notice is still responsible for appearing. That fact explains a large share of missed dates.

If you know in advance you cannot make an upcoming date, act before it passes. Georgia municipal courts allow counsel to waive a client's appearance in many misdemeanor traffic matters, so the lawyer stands in for you. This must be arranged ahead of the court date, not after you have missed it.

Jury Trial Options for Fulton State Court or DeKalb County State Court

Since the City of Atlanta spans into parts of both counties, this central court processes all paperwork.
